In some cases, for example if you want to sell part of your own garden to your neighbour, but also if you want to include a piece of green space from the municipality in your own garden, it may be necessary to split the plot. This division means that a new plot must be formed at the Kadaster, which can be transferred separately. The split can take place either before or after the legal transfer. There are a total of three different options, each with a different method of operation and a different cost. But how do you know which method best suits your situation? You can do so via dhafileshub.

Option 1: prior to transfer with final boundaries and areas

The first option is the cheapest, but requires careful planning. The measurement by the Land Registry will then take place prior to the notarial transfer. In this case, as the owner (or authorized representative of the owner), you yourself must instruct the Kadaster to measure the plot.

After the application, you will receive a quotation from the Land Registry containing the final costs. These costs usually amount to € 440.00. After you have approved the quotation, the Land Registry surveyor will visit you. You, as the current owner, designate the new boundaries of the plots to be formed. The new boundaries must be made visible, for example with a fence, a ditch or other topographical elements or features, such as poles or pipes. The land surveyor will then process the new plots in the basic registration of the Land Registry. Because the Kadaster’s offer must be accepted at least 20 working days prior to the notarial transfer in order to guarantee that the plot formation has taken place in time for the notarial transfer, it is important to plan this properly and in good time.

Option 2: Pre-transfer with provisional boundaries and areas

With the second option, the period of 20 working days does not apply. Here too, the new plots are formed prior to the transfer at the notary, but the application can even take place up to a few days before the notarial transfer. In this case provisional cadastral boundaries and areas are used. We can submit this request for you through an application. We then need a cadastral drawing that indicates fairly accurately what the new plots should look like. After we have split the plot, new cadastral plots are created with definitive cadastral numbers, but with provisional cadastral boundaries and areas.

After the transfer of ownership, the Kadaster will visit you for a so-called verification measurement, during which the still provisional cadastral boundaries and areas are determined definitively. Please note: it can take 12 to 18 months (and in the case of new construction or even longer in exceptional cases) before the Land Registry comes by to determine the boundaries definitively. In 2020, the costs for this method of measurement amount to € 760.00 per new plot to be formed (free of VAT). This amount is composed of the plot formation (€ 660.00) and the border formation (€ 100.00 per new border to be formed). An exception applies when the plot to be formed is smaller than 100m² and the purchase price/value is lower than € 5,000.00, in which case the costs amount to a total of € 157.50 (free of VAT).

The aforementioned verification costs will be charged by the Land Registry for each parcel with a provisional boundary that is transferred. If you divide a lot with provisional boundaries in two, and transfer one piece to buyer A and the other piece to buyer B, while both lots still have provisional boundaries, the total costs will therefore be € 1,420.00 (€ 100. 00 (per border) + 2 x € 660.00 (subject to the exception for small parcels again).

option 3: after the transfer

Finally, the measurement can also take place after the notarial transfer. An estimated size is included in the deed of delivery and reference is made to a drawing that we attach to the deed. The notarial deed then serves as an instruction to the Land Registry to carry out the measurement. In this case, the surveyor will contact you after the transfer to schedule an appointment to determine the final cadastral boundaries and areas. The cadastral costs for this in 2020 amount to € 1,325.00 per newly formed plot (free of VAT).
